Terms of Service
Last updated 16 October 2026. In effect from 16 October 2026
1. About these terms
These Terms of Service govern use of The Contractor Hub ('TCH'), a directory and project-collaboration platform for customers, trades, contractors and service businesses in New Zealand.
TCH is run by The Contractor Hub Limited, a New Zealand company (company number 9462988, NZBN 9429053999221) ('we', 'us'). These terms are an agreement between you and the company.
These terms are in effect from 16 October 2026. When we change them we will say so on this page and tell registered users first, as section 11 describes.
You accept these terms by ticking the box that says you agree, when you sign up, buy a plan or accept an invitation. We record which version you accepted and when. If you use TCH for a business, you confirm you are allowed to accept these terms for that business, and 'you' then means the business as well as you. To accept them you must be 18 or older.
The agreement is made up of these terms and the plan details shown to you at checkout. The Privacy Policy explains how we handle personal information. If the plan details and these terms disagree, the plan details win for that plan.
2. Accounts, and what a credential badge means
Give accurate information when you create an account, and keep your login to yourself. A trade or business account is expected to hold the licences, registrations and insurance it needs to lawfully offer the services it lists, and to tell us promptly if one lapses, is suspended or is cancelled.
Credentials on a profile carry one of three states, and the difference matters. Verified means someone at TCH checked the credential against the public register or sighted the certificate, on the date shown. A verification lasts twelve months, and if it has not been redone by then the badge changes to Check expired on its own. Self-declared means the business told us and nobody has confirmed it. Check expired means a verification has aged out and has not yet been redone.
A verification says the credential was on the public record on the day we looked. A register can change after that day, which is why the date is shown. It is not a statement about the quality, safety or timeliness of anyone's work, and it is not a recommendation. For statutory licences we link to the public register so you can check for yourself, and we would rather you did. If you think a badge is wrong, tell us through the Contact page and we will look at it.
A business is responsible for every credential it declares. Declaring one it does not hold breaches these terms and may also breach the Fair Trading Act 1986.
3. Listings, reviews, and the content you post
Businesses are responsible for the accuracy of their own profile. Some listings are built from public information before the business has joined TCH. A business can claim its listing and correct it, or ask us to take it down using the link on the listing.
Reviews must describe a genuine experience of the business reviewed. Do not review your own business, a business you are connected to, or a competitor, and do not offer anything in return for a review. We remove content that is false, defamatory, unlawful, or breaches these terms. We do not remove a review only because it is critical.
Content you post stays yours: profile text, photographs, reviews, showcase entries and the rest. By posting it you give us a non-exclusive, royalty-free permission to store, copy, display and adapt it (for example, resizing a photograph) so that it can be shown on TCH, in search results, and in links to TCH shared elsewhere. Our service providers may hold it overseas, as the Privacy Policy explains. We will ask you before using your photographs or your business name in paid advertising for TCH.
That permission ends when you delete the content or close your account, except for copies already sent to someone else, a review that stays up under the reviewer's name, and backup copies we keep for a limited time, as section 9 of the Privacy Policy describes.
You are responsible for having the right to post it in the first place, including for photographs of work done for someone else. If you believe something on TCH infringes your rights or is unlawful, tell us through the Contact page.
4. Jobs, tenders and quotes
TCH is where a customer posts work and a trade responds. Any contract for that work is between the customer and the business directly. TCH is not a party to it, does not supervise it, and does not guarantee the quality, safety or completion of anything built.
We do not check the price, scope or terms of a quote or tender. Where a business takes payment of an invoice by card through TCH, the payment is processed by Stripe and goes to that business's own Stripe account, under Stripe's terms. TCH does not hold that money.
5. The project tools, and the documents they produce
The project workspace produces documents that legislation attaches consequences to, including payment claims, payment schedules and retention trust statements under the Construction Contracts Act 2002.
Those are tools. They assemble what you put into them. You remain responsible for whether a document you issue is correct, complete and served in time, and for what follows if it is not. Whether sending a document through TCH counts as valid service depends on your contract and the Act, so check that before you rely on it. Prompts about statutory deadlines are reminders drawn from the dates in your own project, not legal advice, and TCH does not give legal advice.
Some features draft text for you using an artificial intelligence service. A draft can be wrong or incomplete. Read it and correct it before you send or rely on it, because once you send it, it is your document.
Your project records are yours. We use them to provide the service to you and the people you share them with, and for nothing else except as the Privacy Policy describes. When you add information about other people, such as clients, crew or subcontractors, you are responsible for being allowed to share it with them on TCH.
6. Membership and payment
Membership tiers, listing fees and advertising are billed as described at checkout, in New Zealand dollars. The price shown at checkout is the total amount you pay, and where GST applies it is included in that price. Some features are free.
Monthly plans renew each month and annual plans renew each year, charged to the payment method you gave at checkout, until you cancel. You can cancel at any time from your account. Cancelling stops the next renewal, and you keep the paid features until the end of the period you have already paid for.
If a payment fails we will tell you, and if it is still unpaid after that we may pause paid features until it is paid. Your records stay in place.
We may change a plan's price for future billing periods. We will tell you by email at least 30 days before a new price first applies to you, and you can cancel before then without paying it. A price you have already paid for a period does not change. A price lock offered to you when you joined, such as a founding rate, is honoured as described in that offer.
Fees already paid are not refunded on cancellation, except where the Consumer Guarantees Act or another law says otherwise, or where these terms say we refund you (sections 10 and 11). Nothing in this section takes away a right you have under those laws.
7. Escrow is not switched on
The site describes an escrow feature for milestone payments. It is built but switched off. No money can be held through TCH, nothing on the site is an offer of a payment or financial service, and these terms do not cover one. If escrow is introduced it will have its own terms, and members will be told before it starts.
8. Acceptable use
Don't misuse the platform. That includes posting false listings, circumventing fees, and using contact details obtained through TCH to market unrelated things to people who did not ask. Sending commercial messages without consent can also breach the Unsolicited Electronic Messages Act 2007.
Don't harass or threaten anyone, impersonate a person or business, post anything unlawful, upload anything harmful such as malware, or try to get into accounts or parts of TCH that are not yours.
Don't extract TCH's own data in bulk, by scraper, crawler or otherwise, or use it to build a competing directory. This is about TCH's database and pages. It does not stop you checking a credential yourself on the public register it came from, which we link to on purpose.
9. Liability
TCH connects people and provides tools. It does not carry out trade work, and it is not a party to the contracts formed through it. We are not responsible for the work, quotes, content or conduct of other users, though we remain responsible for our own conduct, including what we say on a credential badge.
We provide the service with reasonable care and skill. We do not promise it will always be available or free of errors, and it depends on providers we do not control, such as hosting, email and payment services. Keep your own copies of documents you must keep by law.
If you are a consumer under the Consumer Guarantees Act 1993, nothing in these terms limits the guarantees that Act gives you, and nothing limits your rights under the Fair Trading Act 1986. Those rights cannot be contracted out of for a consumer, and we do not try to.
If you acquire TCH's services in trade, for the purposes of a business, then you and we agree that, to the extent the law allows: the Consumer Guarantees Act and sections 9, 12A and 13 of the Fair Trading Act do not apply between you and us, and it is fair and reasonable for both of us to be bound by this clause. We think it is fair because the service is sold at a published price, can be cancelled at any time, and assists with work for which you keep professional responsibility. This does not affect anyone else's rights, or the Commerce Commission's powers.
In that case our total liability to you, for all claims, is limited to the fees you paid us in the twelve months before the event that gave rise to the claim, and neither of us is liable to the other for indirect or consequential loss, including lost profit or lost business. Our liability is also reduced to the extent you caused or contributed to the loss.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited. The limit above does not apply to loss caused by our fraud or wilful misconduct, or to a refund we owe you under these terms.
10. Suspension, and ending an account
You can close your account at any time. We may suspend or close an account that seriously or repeatedly breaches these terms, that has not paid fees owed after we asked, or where we must by law or to protect other people from harm. Where we do we will say why unless there is a legal reason not to, and unless the breach is serious or urgent we will first give you a reasonable chance to put it right.
If we close a paid account when you have not breached these terms, or we stop offering TCH or a paid plan, we will give you at least 30 days' notice where we can and refund the part of any prepaid fee that covers the time after it ends.
Before we close an account for a reason other than a serious breach, we will give you a reasonable opportunity to get a copy of your project records. Ask us through the Contact page.
Closing an account does not by itself withdraw content you have already sent to someone else, such as a quote to a customer or an application to a business. Section 5 of the Privacy Policy explains what happens to careers data, and section 9 of it sets out how long we keep things.
11. Changes to these terms
We may update these terms when the platform, the law or our services change. Every version is dated on this page.
Where a change materially affects you, we will email registered users at least 30 days before it takes effect and say what is changing, and we may ask you to accept the new version when you next sign in. A change needed to comply with the law, or one that only benefits you, may take effect sooner.
A change does not apply to anything that happened before it took effect. If you do not agree to a change, you can cancel before it takes effect, and if you are on a prepaid plan we will refund the part of the fee that covers the time after you cancel.
12. Law, disputes, and how to reach us
These terms are governed by New Zealand law, and the New Zealand courts have jurisdiction.
If you have a problem with TCH, tell us first through the Contact page and we will try to sort it out with you. That does not stop you taking a claim to the Disputes Tribunal, the courts or any other body that has jurisdiction.
Questions about these terms can be sent through the Contact page. How TCH handles personal information is set out separately in the Privacy Policy, which is in effect. We will contact you at the email address on your account.
13. General
We may transfer this agreement to another business that takes over running TCH. If we do, we will tell you, and your rights under these terms carry over. You can cancel if you do not want to continue. You may not transfer your account without our agreement.
If part of these terms cannot be enforced, the rest still applies. If we do not enforce a term straight away, we can still enforce it later.
